[ARCHIVED] Bylaw 31/19: Proposed Text Amendments to ILO Policies

Bylaw for 2nd & 3rd Reading - September 30, 2019 R.M. Council Meeting

The following Bylaw will be considered for 2nd and 3rd Readings at 11:00 a.m. on September 30, 2019 during the regular R.M. Council meeting. If you would like to speak to the bylaw, please contact the Planning Department in advance of 5 p.m. on September 24, 2019.

  • Proposed Bylaw No. 31/19 will provide for amendments to the R.M. of Corman Park Development Plan (OCP). The purpose of the amendments is to update the policies for Intensive Livestock Operations (ILO’s) approvals. Policy amendments will give Council the opportunity to consider recommended separation distances when granting ILO approvals and the ability to site the ILO within those recommended separation distances. Previous policy allowed for a condition of approval to be added requiring the execution of a written “co-existence” agreement which was left to an applicant and landowner to negotiate. Oftentimes a final approval could not be granted due to an inability for the parties to execute the agreement. Amendments include:
    1. Removal of the requirements to enter into “co-existence” agreements in order to subdivide and/or develop land;

    2. Add a process for Council to consider siting of ILO’s within recommended separation distances subject to a number of factors. The ability to locate a use within the recommended separation distance will be made by Council instead of requiring a “co-existence” agreement to be negotiated between the parties;

    3. Replacing “Table 1” in section 4.2 with a consolidated list of uses and required setback distances in accordance with animal units;

    4. Updating the items Council reviews with ILO applications to include watershed and drainage patterns, runoff management, access roadways, the land use designation and future land use of adjacent lands; and

    5. Repealing “Appendix C” which is a map within the OCP intended to illustrate the setbacks for existing ILO’s as the information on the map is inaccurate and out of date which causes confusion in implementation.
